Probate
When the unfortunate time comes that a loved one passes away in the State of Missouri, it is possible that his or her estate may be required to undergo a process in our courts commonly referred to as probate. Through this process, the assets of the deceased are catalogued, managed, and ultimately distributed by the court to the lawful heirs of the deceased. If your loved one failed to properly prepare their estate plan while living, or often even when estate planning was completed, this probate process will be required. During this probate process, not only will the court distribute the assets of the deceased to the lawful heirs, but any creditors of the deceased also have a right to file a claim. Due to the relatively complex legal work involved in opening and administering a probate estate, it is a task that is very difficult to complete without the help of an attorney that is knowledgeable in probate law.
