Premises Liability
Premises Liability
is a legal term that refers to the duty of care owed by a landowner or possessor of property to individuals on his or her property. While most people think of a slip and fall when they think of a premises liability case, it can include many different types of accidents and situations. For example, it may include negligent supervision at a day care or even on a school bus. It may include having inadequate security to protect an injured victim or insufficient safety mechanisms or policies in place to prevent an injury. Premises liability accidents can occur anywhere, but the following are locations where premises liability accidents often occur:
- Apartment Buildings
- Grocery Stores
- Convenience Stores
- Restaurants
- Hotels
- Shopping Malls
- Sporting Events or Concerts
- Day Cares
- School Buses
- Swimming Pools
Premises liability accidents can lead to various types of injuries, from very minor to serious. They also almost always involve what is known as “comparative fault”, which varies depending if your accident occurred in Missouri or Kansas. Insurance companies often rely upon comparative fault to deny a premises liability claim if you are not represented by an attorney. It is important to have an attorney that is experienced in premises liability law to assist you with your claim and be prepared to take your case to trial if necessary. The attorneys at Welch & Webb prepare each case to go to trial.
